STATE of Missouri, Respondent, v. Lyle Christopher MCCURRY, Appellant.
ORDER
Lyle McCurry appeals the judgment of the Circuit Court of Johnson County convicting him, after a jury trial, of first-degree rape, first-degree sodomy, first-degree kidnapping, and third-degree assault. On appeal, McCurry asserts the trial court erred in admitting portions of the recording of his interview with law enforcement and in refusing his proffered penalty phase jury instruction. Finding no error, we affirm. Because a published opinion would have no precedential value, we have instead provided a memorandum of law to the parties. Rule 30.25(b).
