IN RE: Petition for DISCIPLINARY ACTION AGAINST Gregory S. WALZ, a Minnesota Attorney, Registration No. 0183891.
ORDER
The Director of the Office of Lawyers Professional Responsibility has filed a petition for disciplinary action alleging that respondent Gregory S. Walz has committed professional misconduct warranting public discipline—namely, respondent engaged in representation of multiple family members, including himself, see Minn. R. Prof. Conduct 1.7(a)(2); repeatedly filed frivolous pleadings or appeals, see Minn. R. Prof. Conduct 3.1, 3.2, 8.4(d); knowingly disobeyed numerous court orders and failed to comply with orders to show cause, see Minn. R. Prof. Conduct 3.4(c), 8.4(d); repeatedly made statements knowing they were false or with reckless disregard as to their falsity regarding the integrity of several judges including the court of appeals, see Minn. R. Prof. Conduct 4.1, 8.2(a), 8.4(c), 8.4(d); made knowingly false statements about opposing counsel and the process to the court, see Minn. R. Prof. Conduct 3.3(a), 4.1, 8.4(c)–(d); made statements about co-counsel, opposing counsel, and the courts with no substantial purpose other than to embarrass and burden the subjects, see Minn. R. Prof. Conduct 4.4(a); and falsely claimed in a tax document that he paid $487,888.71 to co-counsel, see Minn. R. Prof. Conduct 8.4(c).
Respondent and the Director have entered into a stipulation for discipline. In it, respondent waives his rights under Rule 14, Rules on Lawyers Professional Responsibility (RLPR), and unconditionally admits the allegations of the petition. The parties jointly recommend that the appropriate discipline is a six-month suspension.
This court has independently reviewed the file and approves the jointly recommended disposition.
Based upon all the files, records, and proceedings herein,
IT IS HEREBY ORDERED THAT:
1. Respondent Gregory S. Walz is indefinitely suspended from the practice of law, effective 14 days from the date of this order, with no right to petition for reinstatement for six months.
2. Respondent may petition for reinstatement pursuant to Rule 18(a)–(d), RLPR. Reinstatement is conditioned on successful completion of the written examination required for admission to the practice of law by the Minnesota State Board of Law Examiners on the subject of professional responsibility, see Rule 18(e)(2), RLPR; see also Rule 4.A.(5), Rules for Admission to the Bar (requiring evidence that an applicant has successfully completed the Multistate Professional Responsibility Examination); and satisfaction of continuing legal education requirements, see Rule 18(e)(4), RLPR.1
3. Respondent must comply with Rule 26, RLPR (requiring notice of suspension to clients, opposing counsel, and tribunals), and must pay $900 in costs pursuant to Rule 24(a), RLPR.
