IN RE: Petition for DISCIPLINARY ACTION AGAINST Ryan M. PACYGA, a Minnesota Attorney, Registration No. 0321576.
ORDER
The Director of the Office of Lawyers Professional Responsibility has filed a petition for disciplinary action seeking reciprocal discipline after respondent Ryan M. Pacyga was publicly censured in Colorado for failure to determine whether his representation of a client would be adversely affected by his personal conflict and personal interest in the client and for failure to recognize the impact of his traumatic brain injury on his ability to represent the client. See Colo. RPC 1.7(a)(2).
Respondent and the Director have entered into a stipulation for discipline. In it, respondent waives his procedural rights under Rule 12(d), Rules on Lawyers Professional Responsibility (RLPR), and unconditionally admits the allegations of the petition. The parties jointly recommend that the appropriate discipline is a public reprimand.
This court has independently reviewed the file and approves the jointly recommended disposition.
Based upon all the files, records, and proceedings herein,
IT IS HEREBY ORDERED THAT:
1. Respondent Ryan M. Pacyga is publicly reprimanded.
2. Respondent must pay $900 in costs pursuant to Rule 24, RLPR.
