Pursuant to Supreme Court Rule IX, Section 1, generally, no application for reconsideration may be considered except for extraordinary circumstances. Following the filing of the application for reconsideration, Justice Penzato voluntarily recused herself from further participation in this matter. As such, the fact that Justice Penzato participated in the original writ consideration and disposition does constitute such extraordinary circumstances. Accordingly, reconsideration by the remainder of this Court is warranted and is hereby granted. See Towbin v. Fuller, 26-00296, p. 2 (La. 3/31/26), ___ So. 3d ___, 2026 WL 899136 at *2.
Upon reconsideration by the remaining members of this Court, the Court declines to modify its original determination to deny certiorari in this matter.
RECONSIDERATION GRANTED; RELIEF DENIED.
