Christopher PIAZZA v. Bret JOHNSTON, C.T. Traina Inc., et al.
Writ application denied.
The central issue in this case—whether the defendant was acting within the course and scope of his employment at the time of the accident—involves numerous factual disputes that make summary judgment inappropriate for any party. I would grant the writ application and reverse the January 13, 2026 judgment of the district court granting plaintiff's motion for partial summary judgment. In all other respects, I would deny the writ application.
I would grant in part and reverse the trial court's grant of plaintiff's motion for summary judgment.
I dissent and would grant the writ in part finding that there are sufficient questions of fact to make summary judgment in favor of either party inappropriate at this time. Therefore, I would reverse the January 13, 2026 judgment of the district court. In all other respects, I would deny the writ.
