LOUIS NOEL v. CHEVRON U.S.A. INC., ET AL.
In Joseph v. Huntington Ingalls Inc., 18-2061, p.13 n.8 (La. 1/29/20), 347 So.3d 579, 590 n.8, this court acknowledged the existence of a nuisance settlement when a plaintiff who had not been diagnosed with any specific illness settled his claim for a nominal sum. See also Breaux v. Mine Safety Appliances Co., 98-133 (La. App. 5 Cir. 8/25/98), 717 So.2d 1255. The instant case is a nuisance settlement. It is illogical to expect that the plaintiff, who later developed lung cancer, intended to release the defendants from liability for such a nominal amount ($583.30). I would grant the writ application.
