Phillip Allen WILSON v. Liz MURRILL, in Her Official Capacity as the Attorney General of the State of Louisiana, Hillar C. Moore, Iii, in His Official Capacity as District Attorney for East Baton Rouge Parish
Defendants’ “Motion for Leave of Court to File Original Memorandum in Opposition of Plaintiff's-Appellant's Writ of Certiorari” is granted. Plaintiff's “Motion for Injunctive Relief” is denied. Plaintiff's writ application is denied.
I concur in the result. Although the State's opposition to the writ application was filed untimely, and the reason cited for the filing being filed late is inadequate, as the final arbiter of the law, this court often orders oppositions to be filed to ensure both sides are heard. In this matter, this court more likely than not would have ordered an opposition prior to ruling. Importantly, the delay in the filing of the opposition did not adversely impact the court's taking up this matter for resolution. In sum, the untimely opposition was not prejudicial and did not delay the resolution of this matter.
