Granted. Considering the unusual circumstances presented in these cross-motions for summary judgment, we find the court of appeal should have ordered briefing and allowed the parties an opportunity to request oral argument prior to rendering its disposition on the merits. Accordingly, the February 13, 2026 disposition of the court of appeal is vacated and set aside, and the case is remanded to the court of appeal for further proceedings.1
