Writ granted. The judgment of the court of appeal is reversed, and the ruling of the trial court is reinstated. The court of appeal erred in granting summary judgment in defendant's favor based on a finding that the affidavit that plaintiff produced in opposition was contrary to earlier deposition testimony. As expressed by the trial court, there was not a “black and white contradiction” of testimony.
