Considering the recommendation of the disciplinary board and the record of this matter, it is ordered that the “Petition to Make Deferred Portion of Suspension Executory” is dismissed without prejudice, reserving to the Office of Disciplinary Counsel the right to file new formal charges against respondent based on the misconduct alleged in this petition, if warranted. All costs and expenses in this matter shall be borne by the disciplinary board.
Hughes, J., dissents and would deny the petition. Crain, J., dissents. McCallum, J., dissents.
