Plaintiff's writ application is granted, and the lower courts’ grant of summary judgment in favor of Perrone & Sons, LLC (“Perrone”) is reversed for the reasons assigned by Judge Wicker in her dissent. There are questions of material fact as to whether the defendant, Andrew Michael Thornton, was within the course and scope of his employment at Perrone at the time of the motor vehicle accident; thus, summary judgment is precluded.
