Segal RADHI v. Christie Phuong NGUYEN, et al.
Writ application granted. See per curiam.
Although relator's June 2, 2022 motion for suspensive appeal was premature, any defect as to timeliness in the appeal was cured when the district court signed the written judgment on July 5, 2022. See Overmier v. Traylor, 475 So.2d 1094, 1094-95 (La. 1985) (explaining that “once the final judgment has been signed, any previously existing defect has been cured, and there is no useful purpose in dismissing the otherwise valid appeal.”).
Accordingly, the writ is granted. The judgment of the court of appeal is reversed, and relator's suspensive appeal is reinstated.
