I would grant the defendant's application as I find defendant has sufficiently shown plaintiffs are unable to establish that any alleged defects in its software system caused their damages. Therefore, pursuant to La. C.C.P. art. 966(H), I would order briefing and give the parties an opportunity to request oral argument.
