Granted in part. The district court is directed to conduct the evidentiary hearing on the rescission of relator's pauper status prior to hearing defendants’ exceptions. If the district court maintains relator's pauper status, it should grant a reasonable continuance of the hearing on the exceptions in order to allow relator to present his opposition to the exceptions. In all other respects, the writ is denied.
