Granted in part. Considering the unusual procedural history of this matter, we find the court of appeal erred in assessing all appeal costs against plaintiffs/appellees. In the interest of equity, the judgment of the court of appeal is amended to provide each party shall bear its own costs. See La. Code Civ. P. art. 2164. The writ is denied in all other respects.
