IN RE: MARSHALL LEGACY FOUNDATION
Writ application denied.
I dissent from the denial of this application. I would order a stay, grant the application of Preston Marshall as co-trustee of the Marshall Legacy Foundation, and docket for full consideration by this court.
This Court has the inherent juridical power and original jurisdiction to regulate the practice of law in this state, which includes the authority to prescribe and interpret the Rules of Professional Conduct. La. Const. art. 5, sec. 5(b). See generally Mire v. City of Lake Charles, 540 So. 2d 950, 954 (La. 1989). In light of this constitutional delegation of authority, I would grant this writ application to examine the issues presented with respect to the Rules of Professional Conduct. While the case presents issues arising under Rules 1.9(a), 1.9(c), and 1.10(a), I would grant specifically to address the res nova issue under Louisiana law of whether Rule 1.10(b) contains a temporal requirement.
