STATE of Louisiana IN the INTEREST OF I.M., Jr.
Writ application denied.
This matter presents shocking evidence of prior abuse of children and unfitness of the minor child's biological parents, primarily the biological mother. Moreover, in my view, the juvenile court erred in transferring custody of the minor child, I.M., Jr., from the child's foster mother to the child's biological father, where the record before us indicates the biological mother lives in the same household as the father. For these reasons, I would grant this writ application, reverse the lower courts, and immediately place the child, two and a half years of age, in the custody of the foster mother.
Crichton, J., would grant and assigns reasons. Crain, J., would grant. McCallum, J., would grant.
