IN RE: Michael S. BRADLEY
Petition for interim suspension granted. See order.
ORDER
Considering the Petition for Interim Suspension for Threat of Harm filed by the Office of Disciplinary Counsel, and the response thereto filed by respondent,
IT IS ORDERED that respondent, Michael S. Bradley, Louisiana Bar Roll number 30226, be and he hereby is suspended from the practice of law on an interim basis pursuant to Supreme Court Rule XIX, § 19.2, pending further orders of this court. Pursuant to Supreme Court Rule XIX, § 26(E), this order is effective immediately.
IT IS FURTHER ORDERED that the Office of Disciplinary Counsel may seek the appointment of a trustee(s) to protect the interests of respondent's clients pursuant to the provisions of Supreme Court Rule XIX, § 27, if appropriate.
NEW ORLEANS, LOUISIANA, this _ day of _, 2021.
FOR THE COURT:
/s/ _
JUSTICE, SUPREME COURT OF LOUISIANA
Considering the troubling allegations set forth by the Office of Disciplinary Counsel and the response by respondent, I wholeheartedly agree that interim suspension is warranted pursuant to Supreme Court Rule XIX, § 19.2. However, under our supervisory and plenary authority as found in La. Const. Art. V, § 5, I would also issue reciprocal orders prohibiting the witnesses and the respondent from having any contact whatsoever, unless it is through counsel, until all disciplinary proceedings are completed.
I agree that interim suspension is proper pursuant to Supreme Court rule XIX section 19.2. I also agree with my colleague, Justice Crichton, in his concern that the respondent and witnesses refrain from contact with one another. However, as this is an attorney disciplinary matter, our supervisory and plenary authority is best directed at the respondent, the alleged wrongdoer in this case. Therefore, I would order the respondent to have no contact with any witness in this matter, unless it would be through counsel.
Even so, under the allegations which have been made in this matter, the witnesses, if they feel it appropriate, would be well advised and better served to seek protective measures through local sources.
Crichton, J., additionally concurs and assigns reasons. Crain, J., concurs. McCallum, J., additionally concurs and assigns reasons.
