Guy LECOMPTE v. ST. TAMMANY PARISH SCHOOL BOARD
Writ application denied.
I agree with the Court of Appeal's decision to remand as the underlying judgment fails to explain the capacity in which Mr. Lecompte's roles as teacher, coach, and athletic director compare to the job duties of a clerical worker. In order to ensure that Mr. Lecompte's injuries are not “characteristic of and peculiar to” his employment with St. Tammany Parish School Board – and outside of the jurisdiction of the Office of Worker's Compensation – a full and complete record is necessary to make such determination.
Genovese, J., would grant for reasons assigned by Judge Welch. McCallum, J., would grant for reasons assigned by Judge Welch. Griffin, J., additionally concurs and assigns reasons. Crain, J., recused.
