Writ application denied.
I would grant and docket this case to examine the issue of venue in Orleans Parish Civil District Court under the facts presented. See Cacamo v. Liberty Mutual Fire Ins., 99-3479, p.7 (La. 6/30/00), 764 So. 2d 41, 45 (remarking in dicta that the legislature included the word “only” in La. R.S. 22:1269 “so that article 42 would no longer be read to automatically incorporate supplementary venue provisions”); Green v. Auto Club Group Ins. Co., 08-2868, p.4 n.4 (La. 10/28/09), 24 So. 3d 182, 184 n.4 (citing Cacamo for the proposition that the “addition of the word ‘only’ in the Direct Action Statute was intended to make clear that the venue exceptions ․ did not apply”).
Crichton, J., would grant and assigns reasons.
