Trevor CLIFTON v. Darrel VANNOY, Warden
Writ application denied.
Although defendant claims he has filed an application for post-conviction relief and includes in his Appendix a copy of a First Uniform Application for Post-Conviction Relief and a memorandum in support thereof, the district court and court of appeal state categorically that defendant has not yet filed an application for post-conviction relief. Further, there is nothing noted on the attached application to indicate that it was ever filed in the district court.
Hughes, J., concurs and assigns reasons.
