In light of the three-year federal statute of limitations as provided in 45 U.S.C. § 56 and 46 U.S.C. § 30106, I would grant and docket this matter to determine whether plaintiff's state court case, filed almost twenty-five years after he filed his Jones Act suit in federal court in Ohio, is prescribed.
Crichton, J., would grant and docket and assigns reasons. Crain, J., recused.
