Ernest PAYNE v. STATE of Louisiana
Writ application denied.
I would grant the writ and order the trial court to furnish Mr. Payne with a copy of the transcript of his habitual offender sentencing proceeding, which resulted in his current sentence of seventy years in prison. We should do so regardless of our view of the merits of any potential claim, and regardless of the fact that he was allegedly furnished with one previously. Producing a transcript to Mr. Payne is not cumbersome, and “particularized need” should not be an insurmountable bar.
Johnson, C.J., would grant and assigns reasons.
