STATE of Louisiana v. Eric Paul MCNEIL
ORDER
Writ granted in part. To the extent relator has requested return of seized property (consisting of firearms) that has already been sold at auction, that claim is moot in the context of this criminal case. However, because the district court did not consider relator's additional claim for property (consisting of ammunition, containers, etc.) that was not included in the order of May 16, 2017, authorizing the auction, this matter is remanded to the district court to consider the merits of that claim. See generally La. R.S. 15:41(“Disposition of property seized in connection with criminal proceedings”). In all other aspects, this application is denied.
