Shakti BELWAY v. Gregory Neal THYSSEN
Granted. In the absence of any clear prejudice to the parties, we find the district court erred in excluding the testimony of Dr. Amy Dickson solely on the ground she began the preliminary stages of her evaluation before she had received a copy of the court's order appointing her as evaluator.
We further find the district court erred in excluding the testimony of Dr. Carole Lieberman. See La. Code Civ. P. art. 1425(B) and Official Comment (a) thereto.
Accordingly, the rulings of the district court are reversed. Nothing in this order shall prevent the parties from challenging the admissibility of the testimony on any other grounds. The case is remanded to the district court for further proceedings.
