STATE of Louisiana v. Adolphus WILSON, Sr.
Writ granted in part. Applicant represents that he timely filed a claim for the return of seized property pursuant to La. R.S. 40:2610 on or about July 8, 2011. Accordingly, the application is granted for the sole purpose of transfer to the district court to consider and act on the motion pursuant to La. R.S. 40:2601 et seq. In the event that the court finds that applicant’s claim complied with the requirements set forth in La. R.S. 40:2610(B), the court is ordered to conduct a forfeiture proceeding in accordance with La. R.S. 40:2611. The district court is ordered to provide this Court with a copy of its judgment. The application is otherwise denied.
