Hope Jones MCGILLION, et al. v. Jennifer ENGLADE, et al.
Gary A. Mejia, on Behalf of Deibi A. Mejia-Medina v. Jennifer Englade, et al.
Writ denied.
I would grant the writ application filed by defendant, St. John the Baptist Sheriff Mike Tregre, and reinstate the trial court's ruling granting his motion for summary judgment pursuant to La. C.C.P. art. 966(H). In my view, the trial court correctly found that under these circumstances, Sheriff Tregre is immune under La. R.S. 9:2798.1, and cannot be liable for any tort claims or punitive damages in this case.
Crichton, J., would grant and assigns reasons. Chehardy, J., recused.
