STATE of Louisiana v. Patti M. COX
On Supervisory Writs to the 1st Judicial District Court, Parish of Caddo and The Court of Appeal Second Circuit
Writ granted. Given the state's acknowledgment that the defendant's jury trial claims may have some validity and considering the unique posture in which this case presents itself to this court, this matter is remanded to the trial court for a determination as to whether the defendant is entitled to a jury trial in connection with the misdemeanor charges. See La. C.Cr.P. arts. 493, 493.1, 706, and 779; see also State v. Reynolds, 07-0641 (La. 11/21/07), 968 So.2d 722; State v. Hornung, 620 So.2d 816 (La. 1993).
