Theodule P. NOEL, Jr., et al. v. Samuel J. NOEL, et al.
The writ is granted for the sole purpose of ordering the district court to prepare a judgment for recordation in the public records incorporating the language of the court of appeal's August 2, 2017 judgment providing Samuel J. Noel was not authorized to self-deal under the terms of the January 12, 2006 power of attorney. In all other respects, the writ is denied.
I agree with that portion of the writ grant requiring a judgment to document in the public record the decision of the court of appeal.
I would further allow the fourth supplemental and amending petition. Any malpractice claims would be for Samuel to make, against his attorney. The plaintiffs should be allowed to pursue their conspiracy claim. Such amendments are favored in Louisiana and the criteria are met.
