CHARLES GARDNER v. SAFECO INSURANCE COMPANY OF OREGON
Pursuant to the provisions of Article 966(H) of the Louisiana Code of Civil Procedure, I would grant the defendant's application, order the parties to file written briefs, and allow an opportunity to make a written request for oral argument. Specifically, I find this application raises the question of whether the open and obvious condition of the porch created an unreasonable risk of harm. See Allen v. Lockwood, 14-1724 (La. 2/13/15), 156 So. 3d 650; Bufkin v. Felipe's Louisiana, LLC, et al., 14-0288 (La. 10/15/14), 171 So. 3d 851.
Crichton, J., would grant and assigns reasons.
