STATE of Louisiana v. Shantel PARRIA
Writ application denied.
In my view, the trial court abused its discretion in denying the State's request for a continuance under the circumstances presented here, in which defense counsel failed to comply with Code of Criminal Procedure article 725 until shortly before trial. Accordingly, I would reverse the trial court's ruling, which denied the State's motion to continue and remand the matter with instructions to afford the State a limited 30-day continuance.
Crichton, J., would grant and assigns reasons. McCallum, J., would grant. Griffin, J., would grant.
