STATE of Louisiana v. Jasmine NELSON
Writ application denied.
I would remand for the trial court to retest whether the two search warrants were supported by probable cause after accounting for the errors and omissions in the accompanying affidavits. See State v. Rey, 351 So. 2d 489, 492 (La. 1977), State v. Lingle, 436 So. 2d 456, 459 (La. 1983).
Hughes, J., would grant in part. Genovese, J., would grant in part and remand for evidentiary hearing on the issue of probable cause. Griffin, J., would grant in part and assigns reasons.
