Application for reconsideration denied.
Although I previously voted to grant applicants’ writ application in this matter and continue to believe this matter should have been granted and docketed, I am constrained to decline to reconsider the previous writ denial by former Louisiana Supreme Court Rule IX, § 6.1

1. Former La. S.Ct. Rule IX, § 6 provided that “[a]n application for rehearing will not be considered when the court has merely granted or denied an application for a writ of certiorari․” The Louisiana Supreme Court Rules were repealed and reenacted, effective January 1, 2026 (after applicants filed the current request for reconsideration). Rule IX, § 1 now provides “[a]n application seeking reconsideration of the denial of a writ application shall not be considered absent extraordinary circumstances.”
Weimer, C.J., concurs and assigns reasons. Griffin, J., would grant. Guidry, J., would grant.
