Writ application not considered. The application is untimely. Under Louisiana Supreme Court Rule I, § 3(B), a writ application seeking to review a judgment of the court of appeal shall be filed within 30 days of the mailing of the notice of the judgment of the court of appeal. If a timely application for rehearing has been filed in the court of appeal, in those instances where rehearing is allowed, the writ application shall be made within 30 days of the mailing of the notice of denial of rehearing or the judgment on rehearing. To be timely under Uniform Rules-Courts of Appeal Rule 2-18.2, an application for rehearing shall be filed on or before 14 days after transmission of the notice of the judgment.
The court of appeal issued an opinion on September 24, 2025. The application for rehearing was not filed until the 41st day, on November 4, 2025, and the court of appeal denied rehearing on November 18, 2025. The date rehearing was denied is not used to calculate the timeliness of filing because no timely application for rehearing was filed in the court of appeal. The writ application was not filed within 30 days of the mailing of the appellate court's judgment and is untimely pursuant to Supreme Court Rule I, § 3(B).
