In our review of the record, we find the lower courts erred in dismissing petitioner's suit without allowing an opportunity to amend the petition. We therefore grant the writ application, in part, and remand to the trial court for the sole purpose of allowing the petitioner an opportunity to amend to address the lower court's findings that the petition does not “sufficiently state[ ] a cause of action.”
REVERSED, IN PART, AND REMANDED.
