No. 2025-CC-00989
JASON MORRIS AND JENNIFER MORRIS
VS.
ACCESS HOME INSURANCE COMPANY AND LOUISIANA INSURANCE GUARANTY ASSOCIATION
On Supervisory Writ to the 36th Judicial District Court, Parish of Beauregard
PER CURIAM
Not considered; not timely filed. Although plaintiffs’ July 9, 2025 application to this court was filed within thirty days of the court of appeal's August 5, 2025 denial of rehearing, they were not permitted to take a rehearing from the court of appeal's May 21, 2025 writ denial. 1 See State v. Crandell, 05-1060 (La. 3/10/06), 924 So.2d 122; Morris v. Stueben, 01-0137 (La. 3/16/01), 781 So. 2d 1220.
Rather than dismiss this matter as untimely, I would consider the merits of the application.
FOOTNOTES
1. Plaintiffs argue they were entitled to take a rehearing because the court of appeal consolidated their writ application with an appeal. Despite the consolidation, however, the court of appeal expressly rendered separate dispositions on the appeal and writ. Plaintiffs’ application to this court is limited to the issues raised in the court of appeal's writ denial.
Cole, J., dissents and assigns reasons.
