Granted. Based on our review, we find there is a sufficient factual dispute over the interpretation of the agreement which makes summary judgment inappropriate.

Accordingly, the judgment of the district court granting partial summary judgment in favor of plaintiff is reversed. The case is remanded to the district court for further proceedings.
