SUPREME COURT OF LOUISIANA
NO. 2025-B-1029
IN RE: CHESTER J. ROTHKAMM, JR.
ATTORNEY DISCIPLINARY PROCEEDING
PER CURIAM
In In re: Rothkamm, 23-0513 (La. 5/23/23), 360 So. 3d 834, we suspended respondent from the practice of law for a period of one year and one day. We ordered the suspension be deferred in its entirety, subject to a period of probation.
The Office of Disciplinary Counsel (“ODC”) subsequently moved to revoke probation and make the deferred suspension executory based on respondent's failure to comply with the conditions of probation imposed. Respondent stipulated to the violations charged by the ODC and consented to the revocation of his probation.
After consideration, the hearing committee found respondent failed to comply with the mandates of his probation plan. The committee recommended that respondent's probation be revoked and that the fully deferred suspension be made executory.
The record supports the hearing committee's recommendation. Accordingly, we will grant the motion to revoke respondent's probation, making the previously deferred one year and one day suspension immediately executory.1
DECREE
For the reasons assigned, respondent's probation is revoked and the deferred suspension of one year and one day imposed in In re: Rothkamm, 23-0513 (La. 5/23/23), 360 So. 3d 834, is hereby made immediately executory. All costs and expenses in the matter are assessed against respondent, Chester J. Rothkamm, Jr., Louisiana Bar Roll number 20350, in accordance with Supreme Court Rule XIX, § 10.1, with legal interest to commence thirty days from the date of finality of this court's judgment until paid.
FOOTNOTES
1. The ODC's investigation uncovered potential new instances of misconduct. Nothing in this opinion shall be construed to preclude the ODC from filing new charges if appropriate.
