Joseph J. BAZILE, Jr. and Barbara B. Mire v. GSS HOLDINGS LA, LLC, Veterans Food Mart, LLC, and Occupants at 1227 Veterans Memorial Boulevard in Kenner, Louisiana
Granted. It is well settled that appeals are favored in the law. Unless the ground urged for dismissal is free from doubt, the appeal should be maintained. See, e.g., Duplantis v. Duplantis, 2024-01527 (La. 2/25/25), 401 So. 3d 651, 652. In this case, the grounds for dismissal of the suspensive appeal under La. Code Civ. P. art. 4735 are not free from doubt.
Accordingly, the judgment of the court of appeal is reversed, and the suspensive appeal granted by the district court is reinstated. The case is remanded to the court of appeal for consideration of the suspensive appeal on the merits.
PER CURIAM
Hughes, J., dissents. Crain, J., concurs in the result.
