Rhonda K. OLIVER v. DEPARTMENT OF FINANCE
Writ Granted and made peremptory. It is undisputed the employee in question was not a regular employee as she had yet to complete the working test period. See Civil Service Rule I, § 1 (64). As noted by both the Commission and the court of appeal, Civil Service Rule II, § 4.1 only allows a regular employee to appeal to the Commission. Probationary employees have no right to appeal outside of certain, specific exceptions. Both the Commission and the court of appeal found the employee in question failed to claim or argue a proper exception. Therefore, the court of appeal erred by improperly expanding the jurisdiction of the Commission to hear the employee's appeal. The court of appeal further erred in creating a remedy where none was provided by law. We therefore reverse the court of appeal and reinstate the Commission's ruling.
