Chad HUGHES v. Connie HARGRAVE and Sarwat Gad
Granted. The district court erred in denying relators’ exception of improper venue. The record establishes relators produced sufficient evidence to establish that Sarwat Gad is domiciled in Lafayette Parish, Louisiana. See Landiak v. Richmond, 2005-0758 (La. 3/24/05), 899 So. 2d 535.
Accordingly, the judgment of the district court is reversed, and relator's exception of improper venue is granted. Pursuant to La. Code Civ. P. art. 932(A), the district court is directed to set a reasonable time for plaintiff to remove the objections presented by relators’ objection.1 If plaintiff fails to comply with the order or fails to remove the objections, the district court is directed to transfer the case to an appropriate venue. La. Code Civ. P. arts. 121 and 932(B).
FOOTNOTES
1. In his opposition to relators’ writ application, plaintiff references a December 12, 2024 First Supplemental and Amended Petition in which he makes additional allegations and adds additional defendants. Because this petition was filed after the December 3, 2024 hearing on relators’ exception of improper venue, it is not properly before this court, and we will not consider it.
