There is no settlement to enforce. A settlement has to be in writing or in open court on the record. La. C.C. art. 3072. Best practice in a mediation is to pull out a legal pad, write it down, and get the parties to sign it. An attorney cannot settle a client's claim absent written authority. La. C.C. art. 2997.
