STATE OF LOUISIANA V. A. L. SIMMONS, II
Despite questions about the time and distance between Clarence and Campti, there appears to be sufficient evidence to support the conviction.
I am concerned that in its Opposition to the writ application the State represents that during a recorded jail phone call the defendant “admitted” to his mother that he told a detective his side of the story and “why he shot Mr. Hartford,” citing the court of appeal opinion. The jail calls quoted therein do not include “why he shot Mr. Hartford.”
Misrepresenting the evidence in a case to the Louisiana Supreme Court is a serious matter that could lead to discipline. Care must be taken.
Hughes, J., concurs.
