STATE OF LOUISIANA v. JOSE LAGOS
While a defendant who has been deported cannot comply with the requirements set forth in La. R.S. 15:561.5, as deportation renders those requirements unfeasible, there are other considerations raised by this writ application. First, in my view, some procedural monitoring safeguard should be implemented to ensure that defendant does not illegally reenter the country. Second, there is no proof in this record documenting and/or confirming defendant's deportation. Absent some actual evidence of a defendant's deportation, a petition seeking to terminate the supervisory release requirements as allowed by to La. R.S. 15:561.2 B should not be considered.
