I agree with the decision to deny the writ. Applicant failed to follow court rules in the effort to seek review of the trial court's decision. Applicant first failed to follow the Uniform Rules of the Court Appeal, as reflected in the court of appeal's October 31 Order. Applicant likewise failed to follow the rules for writ applications set forth by this Court. La. Sup. Ct. R. 10, sec. 3(5).

I would grant the writ application based on the representations of defense counsel. If opponent's representations are accurate, which will be investigated, and defense counsel has a trial in federal court beginning the same day as the trial in this case and has not sought a legislative continuance for that trial, the matter will be referred to the Office of the Louisiana Disciplinary Counsel.
