TULLY v. GRANILLO (2024)

Writ granted. Plaintiff's evidence satisfied her burden of proof on causation for the motion for partial summary judgment. See La. Code Civ. P. art. 966(D)(1). Defendants then failed to present evidence setting forth specific facts showing there is a genuine issue for trial concerning causation. See La. Code Civ. P. art. 967(B). The trial court properly granted plaintiff a partial summary judgment finding the subject automobile accident caused plaintiff's neck and back injuries. See La. Code Civ. P. arts. 966(A)(3) and 967(B). We reverse the court of appeal, reinstate the trial court's partial summary judgment, and remand the case to the court of appeal to reconsider its ruling on plaintiff's motion in limine and, if necessary, the pretermitted assignments of error on quantum.
