Granted in part. In the absence of agreement by all parties, the district court erred in ruling on the cross-motions for summary judgment without conducting a contradictory hearing. See La. Code Civ. P. art. 966(C)(1)(a).
Accordingly, the district court's February 22, 2024, judgment is vacated. The case is remanded to the district court to conduct a contradictory hearing on these motions.
In all other respects, the application is denied.
