LOUISIANA ENERGY GATEWAY, LLC v. TRUNKLINE GAS COMPANY, LLC
Granted. The district court did not abuse its discretion under La. Code Civ. P. art. 3612(B) in denying defendant's request for a suspensive appeal. Accordingly, the judgment of the court of appeal is reversed, and the judgment of the district court granting defendant a devolutive appeal is reinstated. Defendant's request for stay is denied as moot.
I join in the per curiam and further agree with Judge Stiles that the trial court opted not to use its discretion but instead followed the plain language articulating the default rule of La. C.C.P. art. 3612(B).
