Granted. Considering the evidence of relator's repeated good faith attempts to obtain the transcript, we find the court of appeal erred in declining to reach the merits of the application based on a violation of Rule 4-5 of the Uniform Rules of the Courts of Appeal. The case is remanded to court of appeal to consider relator's arguments on the merits, including his request that the court of appeal order the court reporter to produce the transcript directly.
