Catina BRAXTON-ROBERTSON v. SEWERAGE & WATER BOARD OF NEW ORLEANS
Appellant, pro se, Catina Braxton-Robertson (hereinafter “Mrs. Braxton-Robertson”), seeks review of the Civil Service Commission's July 28, 2025 decision denying the appeal of her termination of employment from Sewerage and Water Board. For the reasons that follow, we dismiss the appeal.
Discussion
On August 25, 2025, Mrs. Braxton-Robertson filed a motion to appeal the Civil Service Commission's July 28, 2025 decision denying the appeal and upholding her termination of employment. The order of appeal set a return date of December 24, 2025 and the appeal was lodged with this Court on December 30, 2025. Notice of the briefing schedule was sent to all parties. On January 27, 2026, this Court granted Mrs. Braxton-Robertson's motion for extension of time to file the appellant brief, which was due no later than February 23, 2026. On March 4, 2026, the Clerk of this Court sent notice to Mrs. Braxton-Robertson advising that no appellant brief has been filed and the appeal would be dismissed within thirty (30) days unless an appellant brief is filed. On June 5, 2026, this Court ordered Mrs. Braxton-Robertson to show cause, in writing no later than June 11, 2026, why the appeal should not be dismissed for failure to file the appellant brief. Mrs. Braxton-Robertson did not file a brief by this Court's deadline and did not seek a second extension to file a brief.
Uniform Rules, Courts of Appeal, Rule 2-8.6 provides,
For civil appeals, if an appellant does not file a brief within the time prescribed by Rule 2-12.7 or any extension thereof granted by the court as provided by Rule 2-12.8, a notice shall be transmitted by the clerk to counsel for the appellant, or to the appellant if not represented, that the appeal shall be dismissed 30 days thereafter unless a brief is filed in the meantime. If an appellant does not file a brief within 30 days after such notice is transmitted, the appeal shall be dismissed as abandoned. Provided, however, that irrespective of the time limit provided in Rule 2-12.7 for the appellee to file a brief, the appellee's brief shall be filed within 20 days from the due date shown on the notice of abandonment.
Mrs. Braxton-Robertson failed to file the appellant brief by June 11, 2026 and she has failed to show cause why the appeal should not be dismissed. We find Mrs. Braxton-Robertson has not indicated an intent to pursue her appeal. Accordingly, Mrs. Braxton-Robertson's appeal is deemed abandoned and is dismissed in accordance with Uniform Rules, Courts of Appeal, Rule 2-8.6.
